What's wrong with NACP?
Civil society activists collected specific examples how the National Agency on Corruption Prevention (NACP) turned into the paralyzed and fully controlled by the authorities agency.

With the help of these facts we want to show the political dependence of the NACP, which only creates the visibility of effective work, and, in fact, only fulfills wishes of the leadership of the country. This is some kind of help to corrupt officials and reprisal over political opponents.
The only way out is to restart the agency.
The NACP started its work in 2016 as the special agency on corruption prevention. However, already during the first year of existence it showed that the leadership of the agency deliberately sabotaged the work of the register of civil servants' declarations and blocked the main functions assigned to it.

At first, the agency delayed the beginning of work of the register of declarations and refused from the already developed automated verification system of declarations. If such system was immediately launched, it would take few days to make basic verification of one million of declarations.

It is revealing that it happened after the software was "radically transformed" and taken under control by special services, according to the President Poroshenko. It is about the same automated verification that was launched in fall 2018 when it became the non-negotiable condition for Ukraine to receive international financial support.

The NACP also successfully released from the submission of declarations the leadership of the SBU and decided to conceal declarations of military prosecutors who had repeatedly became subjects of journalists' anti-corruption investigations.

After introducing the automatic verification of declarations with state registers, the NACP changed the procedure for their verification. However, changes to the procedure of full verification of declarations create opportunities to manipulate the process and its results. Moreover, nobody can know about them because they are not provided even for the request.

Almost every third decision on results of full verification of declarations (approved by the NACP in 2017 and 2018) was approved in the absence of some responses to the verification requests. There is no sense in such verifications, but they are beneficial for officials, because in this way officials actually get the indulgence. This is the official document which confirmes that they are not corrupt.

All these facts allow corrupt officials to continue to avoid punishment for submitting false information in declarations or illicit assets.

At the same time, it is obvious that the NACP is used as the large resource to selectively prosecute certain civil servants and law enforcement officers who managed to go against the system.

And all this does not prevent the agency leadership to issue bonuses to themselves almost every month in the amount of several salaries.

NAPC, whom it helps and how?

This chapter includes examples how the NACP allowed not to submit declarations to more than 30,000 officials. Namely: employees of the SBU and military prosecutors. This actually makes it impossible to punish them for the lie in declarations. Because e-declarations of these officials are seen only by employees of the NACP or its departments, which do not bear any threat to them. Some, using their position, are trying to remain "secret agents" in other positions. And the NACP completely ignores this avoidance from submitting declarations.

The NACP's grave
We added cases to this chapter that show how the NACP closes its eyes on gross violations. Some cases are lying for more than a year without any decisions. 96% of declarations, the full verification of which the NACP completed in 2017-2018, were not verified in time. The NACP deliberately delays the deadline for prosecution, explaining it by the duration of the verification. In fact, cases are simply lying, waiting until the annual term for the punishment will expire and they can be simply closed.

The explanation to help corrupt officials
Here, we describe how the NACPs' explanations allow corrupt officials to find different way how not to submit their assets in declarations. Or they tie hands to detectives and prosecutors who can not initiate criminal proceedings without the "permission" of the NACP. It is obvious that "permissions" are not easy to get.

What is the solution?
These facts show the ineffectiveness and full control of the power over members of the National Agency on Corruption Prevention.
The only way out from this situation is to restart the whole NACP
First of all, it is necessary to terminate authority of existing members of the NACP and to choose the new ones. The new competition commission with the decisive participation of independent international experts should do this.

Later, the new leadership of the department should clear the NACP's staff and launch the automatic verification of electronic declarations

Otherwise, the society will not see real punishment for careless attitude to submitting information in declarations, conflict of interests or illegal gifts.
